Terms of Service
These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for the use of the services (hereinafter referred to as the "Service") provided by Tatsuya Co., Ltd. (hereinafter referred to as the "Company") on this website. Registered users (hereinafter referred to as "Users") shall use the Service in accordance with these Terms.
Article 1 (Application)
These Terms shall apply to all matters relating to the use of the Service between Users and the Company.
Article 2 (User Registration)
Registration shall be completed when an applicant applies for user registration by the method prescribed by the Company and the Company approves the application.
The Company may decline to approve a registration application if it determines that the applicant falls under any of the following reasons, and shall bear no obligation to disclose the reasons therefor:
(1) If false information was submitted in the registration application
(2) If the application is from a person who has previously violated these Terms
(3) If the Company otherwise deems the registration inappropriate
Article 3 (Management of User ID and Password)
Users shall manage their User ID and password for the Service under their own responsibility.
Under no circumstances may Users transfer or lend their User ID or password to any third party. The Company shall deem that a login made with a User ID and password combination matching the registered information is made by the User who registered that User ID.
Article 4 (Usage Fees and Payment Methods)
Users shall pay the usage fees separately determined by the Company and displayed on this website as consideration for the use of the Service, by the method designated by the Company.
Article 5 (Prohibited Activities)
Users shall not engage in any of the following activities when using the Service:
(1) Activities that violate laws, regulations, or public order and morals
(2) Activities related to criminal acts
(3) Activities that destroy or interfere with the functionality of the Company's servers or networks
(4) Activities that may interfere with the operation of the Company's services
(5) Activities that collect or accumulate personal information about other users
(6) Activities that impersonate other users
(7) Activities that directly or indirectly provide benefits to antisocial forces in connection with the Company's services
(8) Any other activities deemed inappropriate by the Company
Article 6 (Suspension of Service)
The Company may suspend or discontinue all or part of the Service without prior notice to Users if it determines that any of the following reasons exist:
(1) When performing maintenance, inspection, or updates to the computer systems for the Service
(2) When the provision of the Service becomes difficult due to force majeure events such as earthquakes, lightning, fire, power outages, or natural disasters
(3) When computers or communication lines are stopped due to an accident
(4) When the Company otherwise determines that the provision of the Service is difficult
The Company shall not be liable for any disadvantage or damage suffered by Users or third parties due to the suspension or discontinuation of the Service, regardless of the reason.
Article 7 (Usage Restrictions and Account Cancellation)
The Company may, without prior notice, restrict the use of all or part of the Service or cancel a User's registration in any of the following cases:
(1) If the User violates any provision of these Terms
(2) If it is discovered that false information was included in the registration details
(3) If the Company otherwise determines that the User's use of the Service is inappropriate
The Company shall not be liable for any damage arising from actions taken by the Company pursuant to this article.
Article 8 (Disclaimer)
The Company shall be exempt from liability for non-performance of obligations unless such non-performance is due to the Company's intentional act or gross negligence.
Even where the Company bears liability for any reason, such liability shall be limited to the scope of damages that would ordinarily arise, and for paid services, shall be limited to the amount of the price paid (or one month's equivalent for ongoing services).
The Company shall bear no responsibility for any transactions, communications, or disputes arising between Users and other users or third parties in connection with the Service.
Article 9 (Changes to Service Content)
The Company may change the content of the Service or discontinue the provision of the Service without notice to Users, and shall bear no responsibility for any damage arising from such changes to Users.
Article 10 (Changes to Terms of Service)
The Company may change these Terms at any time without notice to Users when it deems necessary.
Article 11 (Notices and Communications)
Notices and communications between Users and the Company shall be made by the method prescribed by the Company.
Article 12 (Prohibition of Assignment of Rights and Obligations)
Users may not assign or pledge their contractual status or any rights or obligations under these Terms to any third party without the prior written consent of the Company.
Article 13 (Governing Law and Jurisdiction)
These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising in connection with the Service shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Company's head office.
